Third Party Policy Limits Demand – Urgent

Ms. Barnes, a breast cancer survivor in remission, sustained injuries from a fall at a coffee shop in July 2023, experiencing immediate anterior and lateral hip pain with a popping sensation. Initial evaluations revealed significant musculoskeletal deficits, particularly in hip functionality, with decreased strength (3/5 right side, 4/5 left side) and limited range of motion. Multiple conditions were diagnosed, including right hip pain, stiffness, muscle weakness, and cervicalgia. Liability is not seriously in dispute: the hazard was created by your insured, the area was not inspected on the schedule your insured's own policy requires, and no warning was posted. The medical record documents continuous treatment from the date of injury, with imaging confirming the injury and a course of therapy prescribed before any gap in care.
